Assumption of Risk & Waiver

Many of the pleasures of Moofy involve the water, the woods, and the kinds of activities that carry inherent risk. This document outlines the acknowledgments we ask guests to make before participating, so that everyone — guests, the estate, and our partner outfitters — has a shared understanding. A physical version of this waiver is signed on arrival for all participating guests.
Activities covered
This waiver applies to participation in: kayaking, canoeing, paddleboarding, sailing, fishing, crabbing, swimming, hiking, biking, tennis, pickleball, volleyball, archery, paintball, rock climbing, group Olympics, inflatable jousting, and any other recreational activity offered or made available at the estate or by our partner outfitters.
It also covers use of the pool, the pier, the gym, the bicycles, the courts, the art barn, the chicken coop, and the grounds generally.
Inherent risks
Outdoor and recreational activities carry inherent risks of injury, including but not limited to: drowning, hypothermia, sunburn, cuts and abrasions, sprains and fractures, allergic reactions (including to insect stings or food), animal interactions, equipment malfunction, weather-related incidents, and falls. Water activities additionally carry risks associated with sudden weather, boat traffic, currents, and submerged obstacles.
Participants and their guardians (for minors) acknowledge that they understand these risks and accept them voluntarily as a condition of participating.
Your responsibilities
Participants are expected to: follow safety instructions provided by our team or partner outfitters, wear provided safety equipment (life vests when on or near the water, helmets when biking or climbing, eye protection when shooting archery or paintball), avoid alcohol consumption before or during physical activities, supervise children at all times, disclose any medical conditions that may affect participation, and decline activities they are not comfortable performing.
Children
All minors must be supervised by a parent, guardian, or designated responsible adult at all times when on the property, and particularly near water, the pool, the pier, the animals, and any active recreational area. The estate does not provide childcare services.
Medical conditions
If you or anyone in your party has a medical condition (including heart conditions, respiratory issues, recent surgery, pregnancy, severe allergies, or mobility limitations) that may affect participation, please tell us in advance. We will work to accommodate or, where appropriate, recommend that the participant abstain.
By participating, you confirm that you are physically able to do so and that you accept responsibility for your decision.
Release
To the fullest extent permitted by law, you, on behalf of yourself, your heirs, and any guests in your party, release Moofy, its owners, employees, agents, and partner outfitters from any liability for injury, illness, death, or property damage arising from your participation in activities or use of the property — except to the extent caused by gross negligence or willful misconduct.
This release does not limit your rights under any applicable mandatory consumer protection laws.
Emergency contact
Please share an emergency contact with our team on arrival. In the event of a medical emergency, we will administer first aid where appropriate and call for medical services. The nearest hospital (UM Memorial Hospital, Easton) is approximately twenty minutes from the estate.
Acknowledgment
Each guest aged eighteen or older signs a physical copy of this waiver on arrival. For minors, a parent or guardian signs on their behalf. Your group's organizer is responsible for collecting and returning signed waivers for everyone participating.
